This Data Transfer Policy outlines our commitment to protecting personal data transferred across borders in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the General Data Protection Regulation (EU 2016/679 - GDPR), and international data protection standards.
2. Lawful Grounds for Cross-Border Data Transfer
Personal data collected during client intake, due diligence audits, arbitration proceedings, or cross-border contract negotiations may be processed or transferred outside India under the following legal mechanisms:
- Statutory & Professional Necessity: Data processing strictly required to perform contractual services or enforce legal remedies in international arbitrations or cross-border litigations.
- Explicit Client Authorization: Data transferred with explicit written authorization from corporate clients or data principals.
- Adequacy Standards & Standard Contractual Clauses (SCCs): Transfers executed pursuant to Standard Contractual Clauses or approved data transfer agreements incorporating strict encryption standards.
3. Legal Privilege & Confidentiality Shields
All cross-border data transmissions executed by Accendo Law remain subject to attorney-client privilege under Section 126 of the Indian Evidence Act, 1872 / Bharatiya Sakshya Adhiniyam, 2023. Technical measures including AES-256 encryption at rest and TLS 1.3 encryption in transit protect data against unauthorized interception or foreign administrative disclosure.
4. Rights of Foreign & Domestic Data Principals
Regardless of the physical location of server infrastructure, Data Principals maintain rights to request summary confirmation of data processed, seek correction or erasure of outdated personal data, and nominate representatives in the event of incapacity under applicable data privacy statutes.
